Terms of Service

These Terms of Service ("Terms") govern your use of the HeardCheck mobile application and related services ("Service") operated by Kevin Stewart ("we", "us", "our"). By creating an account or using HeardCheck, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use HeardCheck. By using the Service, you represent that you meet this age requirement and have the authority to enter into these Terms.

2. Account Registration

To use HeardCheck, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials (email, password, or PIN) and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.

3. Subscriptions & Payments

Free Tier: Basic features are available at no cost, subject to usage limits (staff, inventory, stations, etc.).

Premium Tier: Premium subscriptions unlock unlimited features for $29.99/month or $299.99/year.

Billing: Subscriptions are billed through Apple's In-App Purchase system. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

You retain ownership of all restaurant data you enter into HeardCheck (menus, orders, schedules, inventory, etc.). By using the Service, you grant us a limited license to store, process, and display this data solely for the purpose of providing the Service to you and your restaurant team.

6. Intellectual Property

The HeardCheck app, including its design, code, branding, and features, is owned by Kevin Stewart and protected by copyright and intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

7. Account Deletion

You may delete your account at any time through the app (Settings > Delete Account) or by visiting heardcheck.com/delete-account. Account deletion is permanent and removes all your personal information and restaurant data within 30 days. Active subscriptions should be cancelled through Apple before deleting your account.

8. Service Availability

We strive to keep HeardCheck available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or data loss.

9. Disclaimer of Warranties

HeardCheck is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements. You use the Service at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of HeardCheck, including loss of data, profits, or business opportunities.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or on our website. Your continued use of HeardCheck after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict of law principles.
