End User License Agreement

This End User License Agreement ("Agreement") is between you and HeardCheck ("Company") and governs your use of the HeardCheck mobile application ("App").
1. License Grant
HeardCheck grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or business use, subject to the terms of this Agreement.
2. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3. Subscriptions and Payments
HeardCheck offers a free tier and paid Premium subscriptions. Premium subscriptions are billed through Apple's App Store as auto-renewable subscriptions. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID settings.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Transmit malicious content, spam, or harassment through the messaging feature
- Share your account credentials with unauthorized users
- Interfere with the operation of the App or its servers
5. Content Ownership
You retain ownership of all data you create within the App (orders, prep lists, inventory counts, messages, etc.). HeardCheck does not claim ownership of your content. However, you grant us a limited license to store, process, and display your content as needed to operate the service.
6. Account Deletion
You can delete your account at any time through the App or by emailing support@heardcheck.com. Upon deletion, your personal data will be removed. Restaurant-level data (orders, inventory history) may be retained in anonymized form.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION. HEARDCHECK IS NOT RESPONSIBLE FOR FOOD SAFETY, HEALTH CODE COMPLIANCE, OR LABOR LAW COMPLIANCE — THESE REMAIN YOUR RESPONSIBILITY.
8. Limitation of Liability
To the maximum extent permitted by law, HeardCheck's total liability to you shall not exceed the amount you paid for the App in the 12 months preceding the claim.
9. Termination
We may terminate or suspend your access to the App at any time for violation of these terms, with or without notice.
10. Changes to This Agreement
We may modify this Agreement at any time. Continued use of the App constitutes acceptance of the updated terms.
